Terms and Conditions For 2c Lake View Villas Holiday Let, Bowness-on-Windermere, Cumbria, LA23 3BP
Contract
The contract is for a short-term holiday rental of the property, specified in the booking process, made between the client and the owner, (“the owner”), Stephen Broadfield, binding from such time that booking is made and inclusive of all the following conditions.
By making a booking the client contracts on behalf of himself/herself and all those in his/her party and represents that he/she has the authority to accept these conditions on behalf of and binding upon all guests in his/her party.
Bookings are accepted on the understanding that the property is taken for holiday purposes only and that, excepting babies, the number of people in each property is limited to those agreed in writing with the owners.
The client and any friends or family of the client visiting the property while the client is staying there must adhere to the conditions of the contract, including the rules and procedures contained in the information folder provided in the property. If inviting friends to visit the client must first seek the permission of the owners. No parties must be held at the property.
Payment
A deposit of 50% of the cost is payable on booking if the booking is made more than 12 weeks before the start of the rental. Bookings are provisional until a deposit is received and are held for 48 hours. The balance, plus the cleaning fee and the agreed security deposit, shall be payable 12 weeks before the commencement of the rental. Non-payment of the balance of the rental fee on or after the due date may be construed as a cancellation of the contract by the client. THE PERSON MAKING THE BOOKING IS RESPONSIBLE FOR ALL AND ANY CHARGES INCURRED FOR MAKING PAYMENT FOR YOUR RESERVATION.
Cancellation
In the event of a cancellation within 8 weeks of the commencement of the booking, then the total cost is payable. Rental fees are non refundable for cancellations made less than 8 weeks prior to commencement of booking, unless the property is able to be re-let for part or all of the cancelled booking period, in which case refunds will be made on a pro rata basis, less the administration fee.
Any cancellation made by the client for whatever reason shall be in writing via e-mail to bookings@lakeslet.co.uk. On receipt of the notice of cancellation we will seek to re-let the property for the period of booking. If a re-letting is achieved, we will refund money already paid by the client less rent for any part of the period, which was not able to be re-let, and less an administrative charge of 20% of the total cost of the booking.
If a cancellation is made more than 8 weeks from the commencement of the booking then any deposit paid will be refunded less a 20% administration fee. We are unable to refund any fees paid to the booking service provider as this is a matter between them and the guest(s).
The client is strongly advised to take out holiday cancellation insurance.
Period of Hire
Rentals for the property commence at 4pm on the day of arrival and terminate at 11.00am on the day of departure.
The arrival time should be arranged in advance. The client should arrange an estimated time with the proprietors and inform them of any changes to that time.
Right of Entry
Whilst respecting the reasonable privacy of the client, the owners of the property reserve the right to access the property at all times.
Care of the Property
The client shall take all reasonable and proper care of the property and its furniture, pictures, fittings and effects in or on the property and leave them in the same state of repair, condition, cleanliness and tidiness as at the commencement of the rental period.
Breakages or Damage
The client is required to inform the owner of any damage or breakage in or around the property promptly so that it can be repaired and replaced for the next client.
The client is bound to reimburse the owners for replacement, repair or extra cleaning costs where reasonably demanded by the owners for damage caused by the client.
Rules and Procedures
Clients are required to observe the House Rules and familiarise themselves with the procedures contained in the information folder provided in the property. The breaking of any house rules will immediately terminate the client’s and their party’s right to stay in the property and there will be no refunds given. In the case of smoking inside or pets being in the property, clients will be liable for the full cost of a professional clean to remove all traces of smoke and / or animal hair. Any guest leaving the property in an untidy state will be charged by the number of hours and for any specialist services required to clean the property, with a minimum charge of £50.
House Rules
- No smoking inside the property – (For those who smoke, there is a covered balcony with seating and an ashtray is provided).
- No pets are allowed.
- No parties or events.
- Check-in is from 4PM and check out at 11am unless previously agreed in writing.
- No shoes or boots are to be worn in the house. There racks for them on the stairway inside the front door.
- Absolutely nothing apart from toilet paper is to be put down the WCs.
- No drying of damp or wet clothes on the radiators as this can damage the decoration.
- Only the people registered at the time of booking may stay in the house and visitors are not allowed without the written permission of the landlord.
- Parties must not be held at the property.
- Upon departure please leave the apartment as you found it: Ensure that the flat is in a tidy condition. Make sure all the washing up is done and all kitchen and dining ware are put away as you found it. Make sure that all windows are closed and secure before you leave.
- Report any breakages or damage to us prior to your leaving the property.
Please abide by these house rules and leave the property in a clean and tidy condition. The person making the booking will be fully responsible for any loss or damages to the property and its contents during their stay and they will be required to pay for any damage or loss. Only proceed with your booking if you are certain that you and everyone in your party has read and understands these rules and agrees to comply with them as making a booking signifies that you agree to both these and the payment terms and conditions.
Liability
The owners of 2c Lake View Villas are not liable for any loss or damage to any client’s property or any property belonging to a member of the client’s party howsoever caused. We recommend that all guests obtain holiday insurance or ensure that their own home insurance covers any such loss or damage.
The client or members of his/her party cannot hold the owners or management of Holland’s liable for any personal injury/death howsoever sustained where the owners and/or their employees have used reasonable skill and care; and/or where caused by the fault of the person(s) affected or any member(s) of their party (including inadequate supervision of children); and/or where caused by the fault of a third party, and/or where caused by an event that could not have been reasonably foreseen or avoided.
